Today, the first suspect to turn himself in voluntarily to the ICC arrived in The Hague following the issuance of a Summons to Appear (this is what the Prosecutor asks for in lieu of an arrest warrant if there is a chance the suspect will appear voluntarily). This is great news – both in terms of attacks on peacekeepers being spotlighted with the seriousness they deserve, and showing an alternate way to respond to being charged with international crimes. While Omar al Bashir responded by expelling agencies that provide a lifeline to civilians, Abu Garda has responded by cooperating with a legal process.
I will be in attendance at his first appearance tomorrow.

قضية المدعي العام ضد بحر إدريس أبو قردة
السيد بحر ادريس أبو قردة (المشار إليه في ما يلي بأبي قردة)، المشتبه بارتكابه جرائم حرب في دارفور (السودان)، حضر طواعية إلى هولندا بعد ظهر اليوم على متن طائرة تجارية. اثر وصوله، تم إخطار ابي قردة من قبل مسؤولين في المحكمة بأمر الحضور الصادر بحقه للمثول أمام الدائرة التمهيدية الأولى غداً الساعة الثالثة بعد الظهر. بعد اللقاء بمحاميه، تم ايصال أبو قردة إلى المكان الذي خصصته المحكمة الجنائية الدولية لاقامته في لاهاي.
مكان إقامة أبي قردة سيظل سرياً ويُعْتبر امتداداً لمباني المحكمة التي يحظر على أبي قردة مغادرتها اذن خاص من الدائرة.
وقد حَيَّت السيدة سيلفانا أربيا، مسجل المحكمة، وصوله بالقول : “إن حضور أبي قردة طواعية قد يفيد في تشجيع مشتبه بهم آخرين ممن لا يزالون فارّين على المثول أمام المحكمة حيث سيتمتعون بكل ضمانات المحاكمة العادلة”.
وكان قضاة المحكمة الجنائية الدولية قد أصدروا للمرة الأولى أمراً بالحضور بدلاً من أمر قبض، فقد كان قضاة الدائرة التمهيدية الأولى مقتنعين بأن أبا قردة سيمثل أمام المحكمة دونما حاجة لاعتقاله.
ما كان لهذه العملية المعقدة أن تتم دون تعاون عدد من الدول. “أنا ممتنة لسلطات هولندا والدول الأخرى التي سمحت بإنجاز هذه العملية، والتي قامت، وفقاً لروحية نظام روما الاساسي، بتقديم الدعم المتواصل لعمل المحكمة”، صرحت السيدة أربيا.
ويُدّعى بارتكاب أبي قردة، الذي ينتمي إلى قبيلة الزغاوة في السودان، ثلاث جرائم حرب خلال اعتداء ضد بعثة الاتحاد الافريقي في السودان، وهي قوة حفظ سلام كانت مرابطة في موقع حسكنيتا العسكري، بمحلية أم كدادة، في شمال دارفور. ويُدّعى بأن اثني عشر جندياً من البعثة قتلوا كما أصيب ثمانية آخرون بجراح بليغة.
وقالت السيدة أربيا، مسجل المحكمة : “اليوم تتوجه أفكارنا إلى عناصر حفظ السلام والعاملين الآخرين في المنظمات الإنسانية الذين يقدممون أساسيات الأمن والعون لمساعدة الملايين من البشر في البلدان التي تواجه نزاعات مسلحة”.
في جلسة المثول للمرة الأولى، سيقوم القاضي كونو تارفوسير (ايطاليا)، الذي يضطلع بمهام القاضي المنفرد، بإبلاغ المشتبه به بالجرائم التي يُدّعى بارتكابه لها وبحقوقه. بعد الجلسة، سيكون أبو قردة حراً في مغادرة هولندا، وسيطلب منه العودة إليها لحضور جلسة اعتماد التهم، السابقة للمحاكمة، والتي ستعقد في غضون مهلة معقولة لتقرير ما إذا كانت هناك أسباب جوهرية للاعتقاد بأنه ارتكب الجرائم المنسوبة إليه.

Situation au Darfour (Soudan)
Affaire : Le Procureur c. Bahr Idriss Abu Garda
Suspecté d’avoir commis des crimes de guerre au Darfour, Soudan, Abu Garda est arrivé volontairement aux Pays-Bas cette après-midi par un vol commercial. Après son arrivée, des représentants de la Cour lui ont notifié l’ordre de comparaitre devant la Chambre préliminaire I demain à 15h00.Après un entretien avec son conseil, il a été conduit dans un lieu assigné par la Cour pour son séjour à La Haye à 18h00.
Le lieu assigné, qui est tenu secret, est considéré comme une extension des locaux de la Cour. La Cour a ordonné à Abu Garda, pendant son séjour aux Pays-Bas, de ne pas quitter les locaux de la Cour sans autorisation spécifique de la Chambre.
Le Greffier de la Cour, Mme Silvana Arbia a salué son arrivée : « la comparution volontaire d’Abu Garda peut servir à encourager d’autres suspects encore en fuite à se présenter devant la Cour afin d’être entendus, avec toutes les garanties d’un procès équitable ».
C’est la première fois que des juges de la CPI émettent une citation à comparaitre plutôt qu’un mandat d’arrêt. Les juges de la Chambre préliminaire I ont estimé qu’Abu Garda se présentera devant la Cour sans qu’il soit nécessaire de l’arrêter.
Cette opération complexe n’aurait pas été possible sans la coopération de plusieurs Etats. « Je suis très reconnaissante envers les autorités des Pays-Bas et d’autres pays qui ont rendu possible cette opération. Dans l’esprit du Statut de Rome, ils ont en permanence soutenu le travail de la Cour », a déclaré Mme Arbia.
Membre de la tribu des Zaghawa du Soudan, Abu Garda doit répondre de trois chefs de crimes de guerre qui auraient été commis dans le cadre d’une attaque lancée le 29 septembre 2007 contre la Mission de l’Union africaine au Soudan (MUAS), une mission de maintien de la paix stationnée à la base militaire de Haskanita, dans la localité d’Umm Kadada au Darfour-Nord. Au cours de cette attaque, 12 soldats de la MUAS auraient été tués et huit autres auraient été grièvement blessés.
« Aujourd’hui, nos pensées vont aux officiers du maintien de la paix et aux autres travailleurs des organisations humanitaires qui fournissent une aide et une sécurité essentielle à des millions de personnes vivant dans des pays confrontés à des conflits armés », a déclaré le Greffier.
Lors de la première comparution du suspect, le juge Cuno Tarfusser (Italie), siégeant en qualité de juge unique, l’informera des crimes qui lui sont reprochés et de ses droits. A la fin de cette audience, Abu Garda sera libre de quitter le pays. Il sera tenu de revenir aux Pays-Bas pour assister à une audience de confirmation des charges, qui sera tenue dans un délai raisonnable afin d’examiner s’il y a des motifs substantiels de croire qu’il a commis ces crimes.

Case: The Prosecutor v. Bahr Idriss Abu Garda
Abu Garda, suspected of having committed war crimes in Darfur Sudan, has voluntarily arrived in The Netherlands this afternoon in a commercial aircraft. After his arrival Abu Garda was notified by Court officials of the order to appear before the Pre-Trial Chamber I tomorrow at 3 p.m. Following a meeting with his legal counsel he was conducted to a location assigned by the Court for his stay in The Hague at 6.00 p.m.
The location that remains confidential is considered an extension of the Court’s premises. During his stay in the Netherlands Abu Garda has been ordered not to leave the premises of the Court without specific authorisation by the Chamber.
The Registrar of the Court, Mrs Silvana Arbia, welcomed his arrival: “The voluntary appearance of Abu Garda might serve to encourage other suspects currently at large to come before the Court to be heard with all guarantees of a fair trial”.
For the first time, the ICC Judges issued a summons to appear instead of an arrest warrant. The Judges of Pre Trial Chamber I were satisfied that Abu Garda will appear before the Court without the need to arrest him.
This complex operation would not have been possible without the cooperation of several States. “I am very grateful to the authorities of The Netherlands and other countries which have made possible this operation. Within the spirit of the Rome Statute, they have been continuously supportive to the work of the Court,” Mrs Arbia said.
Abu Garda, member of the Zaghawa tribe of Sudan, is charged with three war crimes allegedly committed during an attack carried out on 29 September 2007 against the African Union Mission in Sudan, a peace-keeping mission stationed at the Military Group Site Haskanita, Umm Kadada locality, North Darfur. During this attack twelve AMIS soldiers were allegedly killed and eight others were severely wounded.
“Today our thoughts are with peacekeepers and other workers of humanitarian organisations who provide essential security and help to support millions of people in countries facing armed conflicts,” said the Registrar.
At the suspect’s initial appearance, Judge Cuno Tarfusser (Italy), acting as single judge will inform him of the crimes which he is alleged to have committed and of his rights. After the hearing, Abu Garda is free to leave the country. He will be required to return to The Netherlands to attend a confirmation of charges hearing before trial which will be held within a reasonable time to determine whether or not there are substantial grounds to believe that he committed the crimes charged.
