Litigation Overview: Status of same-sex marriage cases

Nov 17 (Reuters) – California’s Supreme Court on Thursday said that the original sponsors of Proposition 8, a ballot initiative prohibiting same-sex marriage in California, can defend the initiative in court.

The state court was responding to a request from the 9th Circuit Court of Appeals, which had asked whether state law authorizes the sponsors to defend Proposition 8, given that the state itself has declined to defend the initiative.

The sponsors have appealed a decision by the U.S. District Court for the Northern District of California, which found last year that Proposition 8 violated the equal protection and due process standards of the U.S.   Constitution. Read the rest of the article as it appeared.
